Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of Parkstatic, including parkstatic.site, the Parkstatic WordPress plugin, the Parkstatic GitHub Action, and the hosted deploy service that connects them (together, the "Service").

By purchasing a license, installing the plugin, using the GitHub Action, or otherwise accessing the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. What Parkstatic provides

Parkstatic lets you build your site in your own GitHub repository, deploy it through GitHub Actions, and serve it from your WordPress domain while keeping WordPress available for administration.

The Service includes:

  • A WordPress plugin that receives authenticated deploys and serves static files from your site. Site settings (metadata and social previews) are available without a paid plan; Deploy requires an active license.
  • A GitHub Action that builds, prerenders, and uploads your project
  • A hosted deploy relay that authenticates deploys and temporarily transfers build artifacts to your WordPress site

You are responsible for your own WordPress hosting, GitHub account, repository, build configuration, and domain. Parkstatic does not host your public website or store your source code beyond what is needed to complete an individual deploy.

3. License and permitted use

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Parkstatic plugin, GitHub Action, and hosted deploy service for one production WordPress site per license, unless your purchase expressly states otherwise.

You may use the Service only to deploy and serve sites that you own or manage with proper authorization. You may not:

  • Resell, sublicense, or redistribute the plugin, Action, or Service
  • Use the GitHub Action except by referencing official published releases in GitHub Actions workflows, as described in our documentation
  • Copy, modify, or create derivative works of the GitHub Action source except as expressly permitted by us in writing
  • Share one license across multiple unrelated production sites
  • Circumvent license, authentication, or usage limits
  • Use the Service for unlawful, harmful, or abusive purposes

The WordPress plugin is distributed under the GNU General Public License v2 (or later). Your use of the plugin's source code is also subject to that license where it applies. These Terms govern your access to the hosted deploy service and other paid features that require an active license.

4. Fees and payment

Access to the hosted deploy service requires a paid license or an active free trial (see section 5). Current pricing is shown on parkstatic.site at the time of purchase (for example, annual or lifetime plans). We may change prices for new purchases at any time; changes do not affect licenses already paid for.

Payments are processed by Freemius, our payment and licensing provider. By purchasing, you also agree to Freemius's applicable terms. You are responsible for any taxes, duties, or charges associated with your purchase unless stated otherwise at checkout.

A valid license must remain active on the WordPress site that receives deploys. If you move your license to a different site, deploys to the previous site will no longer be accepted.

5. Free trial

We offer a 7-day free trial of the paid plans. Starting a trial requires a valid payment method (credit card or PayPal), which is collected and stored by Freemius, not by us. No amount is charged during the trial period.

During the trial you have the same access as a paying licensee, and these Terms apply in full. Unless you cancel before the trial ends, the plan you selected at checkout converts to a paid license automatically at the price shown at checkout, charged through Freemius. Annual plans then renew according to their billing cycle; lifetime plans are charged once.

You can cancel at any time before the end of the trial in the Freemius customer portal, and you will not be charged. Trials are limited to one per customer and per product, and we may withdraw or refuse a trial where we reasonably believe it is being abused. Cancelling a trial ends your access to the hosted deploy service; content already deployed to your WordPress site remains on your own hosting.

6. Updates and support

An active license or free trial includes plugin and Action updates and reasonable support for the period covered by your plan. Annual licenses include updates and support for one year from purchase unless a different period is stated at checkout; renewal is required to continue receiving updates and support after that period. Lifetime licenses include updates and support for as long as we commercially offer the Service, as described at purchase.

We may release improvements, bug fixes, or changes to the Service at any time. We are not obligated to maintain compatibility with every WordPress version, hosting environment, or third-party tool.

7. Your content and responsibilities

You retain ownership of your websites, repositories, and deployed content. You grant us only the limited rights needed to operate the Service-for example, to receive, temporarily store, and relay your build artifacts to your WordPress site.

You are solely responsible for:

  • The content you build, deploy, and publish
  • Compliance with applicable laws, including privacy and intellectual property laws
  • Securing your WordPress admin, GitHub account, and deploy credentials
  • Backing up your site, repository, and configuration
  • Testing deploys before making changes live

You must not deploy content that is illegal, infringing, malicious, or that interferes with the Service or other users.

8. Third-party services

The Service integrates with third parties you choose to use, including WordPress, GitHub, and Freemius (for payments and license management). Your use of those services is governed by their own terms and policies. We are not responsible for third-party outages, policy changes, or data handling outside our control.

9. Service availability

We aim to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, updates, infrastructure issues, or factors outside our control. Deploy delivery also depends on your WordPress hosting, GitHub Actions, and network connectivity.

Some site configurations-such as subdirectory installs or certain client-side routing setups-may require additional configuration on your side. Documentation on parkstatic.site describes known limitations.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, that deploys will be successful in every environment, or that defects will be corrected within a particular timeframe.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKSTATIC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS IF YOU HAVE NOT MADE A PAYMENT.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Parkstatic from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate your access to the hosted deploy service if you breach these Terms, fail to pay applicable fees, or use the Service in a way that poses risk to us or others. You may stop using the Service at any time by uninstalling the plugin and ceasing use of the GitHub Action.

Sections that by their nature should survive termination-including payment obligations already incurred, disclaimers, limitations of liability, and indemnification-will survive.

14. Refunds

Refunds are governed by our Refund Policy, administered through Freemius. The free trial is the primary way to evaluate the Service before paying: if you cancel before the trial ends, no charge is made and no refund is needed. In addition, if within the first 7 days after a payment you experience a defect that makes Parkstatic's material functions unusable and we are unable to resolve it, you are entitled to a full refund. Renewal payments and upgrades are non-refundable. If you believe you are entitled to a refund, contact us at contact@parkstatic.com with your purchase details.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. Governing law

These Terms are governed by the laws applicable where Parkstatic operates, without regard to conflict-of-law rules. Disputes arising from these Terms or the Service will be resolved in the courts of that jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
